Welcome to accessbio.net. The accessbio.net website (the “Website” or “Site”) is comprised of various web pages operated by Access Bio, Inc.  Our Terms & Conditions, found at accessbio.net/terms-conditions, incorporates this privacy policy (the “Privacy Policy” or this “Policy”) into those Terms & Conditions as part of your agreement to those terms and conditions for accessing and using the Website, and any other software application that does not have its own dedicated separate terms and conditions or privacy policy, and any related content, functionality, and services through them.  Protecting your private information is our priority.

Access Bio, Inc. and its affiliates (“Access Bio” “we,” “us,” or “our”) respect your privacy. This Privacy Policy describes the processing of Personal Information (defined below) that is provided, collected, or shared on our website, via email, text, and electronic messages identified through Access Bio’s Website, software application, or other Access Bio platforms that link to this Privacy Policy or do not have their own separate dedicated privacy policy (collectively, the “Platforms”). It also describes your choices about the collection, sharing, and use of your Personal Information. If you do not agree with our policies and practices, your choice is not to use the Platforms. By accessing or using the Platforms, you agree to this Privacy Policy.  This Privacy Policy governs Access Bio’s practices related to data collection and usage. For the purposes of this Privacy Policy, unless otherwise noted, all references to Access Bio include accessbio.net and Access Bio.

This Privacy Policy does not apply to information collected by us offline or by third parties.   It also does not govern the use and disclosure of Protected Health Information (“PHI”) (as that term is defined under HIPAA) that you may share with us in the course of using the Platforms and receiving our services.  For more information on our use and disclosure of your PHI, please review our Notice of Privacy Practices, which is available on the Website.

1. Personal Information We Collect

We may collect a range of Personal Information. “Personal Information” means information that uniquely identifies, relates to, describes, or is reasonably capable of being associated with or linked to you.

The types of Personal Information we collect may include:

  • Contact Information – If you submit an inquiry, register for an account, or provide information on our Platforms, we may collect your contact information. This may include your name, email address, demographic information, and phone number.
  • Financial Information – If you make any purchases through our Platforms, we will collect your financial information, including your name, payment, and other customary billing information.
  • Location Data – While navigating our Platforms, your mobile device or browser may share your location data, both through WiFi and GPS. We will collect this information based on the settings of your phone and browser.
  • Health Information – When using the Platforms, you may need to provide certain information about your health (e.g., health status, test results from our products, and symptoms).  This does not include Health Information subject to HIPAA, which is covered by our Notice of Privacy Practices.
  • Usage Information – When you use our Platforms, our servers may automatically record information, including your Internet Protocol address (“IP Address”), browser type, past log-ins, referring URLs (e.g., the site you visited before coming to our Platforms), domain names associated with your internet service provider, information on your interaction with the Platforms, and other such information.
  • Communication Information – When you make a complaint, submit emails, or upload files, we may maintain these records. We may collect audio, electronic, or visual information, which includes any data in any files uploaded, emailed or otherwise provided by you, the contents of your communications with us, whether via the Website, the Platforms, e-mail, social media, telephone or otherwise, and inferences we may make from other Personal Information we collect.  From time to time, Access Bio may contact you via email for the purpose of providing announcements, promotional offers, alerts, confirmations, surveys, and/or other general communication. In order to improve our Services, we may receive a notification when you open an email from Access Bio or click on a link therein.

2. How We Collect Your Personal Information

  • We May Collect Your Personal Information Directly From You – For example, if you fill out the form in the “contact us” page on our website, register for an account on the Platforms, request or purchase products, services, or information from us, or provide information to us in order to provide our services.
  • We May Also Collect Personal Information From Third Parties – For example, we may work with business partners, subcontractors, advertising networks, analytics providers, and search information providers, who may provide us with Personal Information about you.
  • Through Online Tracking Technologies – Information about your computer hardware and software may be automatically collected by Access Bio when you visit the Site. This information can include your IP address, browser type, domain names, access times, and referring website addresses. This information is used for the operation of the service, to maintain quality of the service, and to provide general statistics regarding use of the Site.We and our service providers may use cookies, device identifiers, and similar technologies such as pixels, web beacons, and local storage to collect usage and browser information about how you use the Platforms.  We process the information collected through such technologies, which may include or be combined with Personal Information, to help operate certain features of the Platforms, to enhance your experience through personalization, and to help us better understand the features of the Platforms that you and other users are most interested in.Cookies Explained.  A cookie is a small file placed on your hard drive that enable our Platforms to remember your information.  Most browsers provide you with the ability to block, delete, or disable cookies, and your mobile device may allow you to disable transmission of unique identifiers and location data. Please keep in mind that if you directly disclose personally identifiable information or personally sensitive data through Access Bio’s public message boards, this information may be collected and used by others.

We do not collect any personal information about you unless you voluntarily provide it to us. However, you may be required to provide certain personal information to us when you elect to use certain products or services available on the Site or Platforms. These may include: (a) registering for an account on our Site; (b) entering a sweepstake or contest sponsored by us or one of our partners: (c) signing up for special offers from selected third parties; (d) sending us an email message; (e) submitting your credit card or other payment information when ordering and purchasing products and services on our Site. To wit, we will use your information for, but not limited to, communicating with you in relation to services and/or products you have requested from us. We also may gather additional personal or non-personal information in the future.

  • Platform Services – we may use information collected to fulfill our service or improve upon our services.  Examples include:
    • Operating the Platforms and troubleshooting issues, or other related services;
    • Fulfilling customer requests, such as to create an account or complete customer purchases;

    • Other product services that arise throughout the Platforms.

    • Responding to inquiries related to employment opportunities;

  • Marketing –  we may use data to enhance our marketing of our products and services.  Examples include:
    • Sending you information about our company, products, services, and promotions;
    • Marketing, advertising, and providing the Platforms and our services;
    • Personalizing marketing material to users who reflect a preference for certain products;
    • Analyzing usage or purchasing trends to better understand how to market our product;
    • Other marketing needs that may arise, for which we will update this policy.
  • Security, Crime, and Fraud Prevention
    • Protecting against criminal activity, claims and other liabilities;
    • Protecting the security and integrity of the Platforms;
    • Monitoring to ensure the accuracy of data collected for purposes of reporting to regulatory bodies;
    • Complying with legal or regulatory obligations;

4. Sharing of Personal Information

We may share your Personal Information in the following circumstances:

  • To Third Parties for Marketing Purposes – We may share your Personal Information with third parties for their marketing purposes. This may include third parties whose services we believe you may be interested, or who are interested in providing you with services.
  • For Legal Obligation or Safety Reasons – When we have a good faith belief that access, use, preservation or disclosure of Personal Information is reasonably necessary to (a) satisfy or comply with any requirement of law, regulation, legal process, or enforceable governmental request, (b) enforce or investigate a potential violation of the Terms & Conditions, (c) detect, prevent, or otherwise respond to fraud, security or technical concerns, (d) support auditing and compliance functions, or (e) protect the rights, property, or safety of Access Bio, its users, or the public against harm.
  • In the Case of a Merger or Sale – If and when we are involved in a merger, acquisition, or any form of transfer or sale of some or all of its business, whether as a going concern or as part of bankruptcy, liquidation, or similar proceeding. Personal Information may be transferred along with the business. Limited to where legally required, we will give you prior notice and if you have a legal right to do so, an opportunity to object to this transfer.
  • To Service Providers – When we hire a service provider to help operate the Platforms or our business (see list of business uses in Section 3 above), we may give access to Personal Information as necessary to perform the service for Access Bio.  This may include service providers that operate our Platforms, send our communications, or run our promotions. Access Bio may also share data with trusted third-party service provider partners to help perform statistical analysis, send you email or postal mail, provide customer support, or arrange for deliveries; services providers that assist Access Bio with the business and Platform uses outlined in Section 3 above; Access Bio’s affiliates; partners; data aggregators; and parent or subsidiary organizations. All such third parties are prohibited from using your personal information except to provide these services to Access Bio or comply with legal requirements, and they are required to maintain the confidentiality of your information.  Access Bio does not sell, rent, or lease its customer lists to third parties. Access Bio may, from time to time, contact you on behalf of external business partners about a particular offering that may be of interest to you. In those cases, your unique personally identifiable information (e.g., e-mail, name, address, telephone number) is not transferred to the third party.  We may also store your data on servers provided by third party hosting vendors with whom we have contracted.
  • To Business Partners – We may share Personal Information with our trusted affiliated companies, vendors, business partners.  For example, we may share your Personal Information with a company when we co-sponsor a promotion or service.  These partners and affiliates may use your Personal Information to, among other things, send you information or contact you about their services and products.

In the preceding twelve (12) months, Access Bio has not sold personal information.

5. How Long Do We Keep Your Personal Information

We will retain your Personal Information for as long as necessary to fulfill the purposes for which it has been collected, as outlined in this Privacy Policy, or any longer retention period required by law.

6. How We Protect Your Personal Information

We use our commercially reasonable efforts to protect the confidentiality and security of Personal Information we process. However, despite these efforts to store Personal Information in a secure operating environment, we cannot guarantee the security of Personal Information during its transmission or its storage on our systems. Further, while we attempt to ensure the integrity and security of Personal Information, we cannot guarantee that our security measures will prevent third parties such as hackers from illegally obtaining access to Personal Information.  Any transmission of information to us is at your own risk. You agree that Access Bio is not liable for the unauthorized release of your information unless such release was the result of gross negligence or willful misconduct on the part of Access Bio.

7. Your Choices and Controls

Cookies – You have the ability to accept or decline cookies. Most Web browsers automatically accept cookies, but you can usually modify your browser setting to decline cookies if you prefer.

Except to the extent required by law, we reserve the right to refuse requests to change or delete data. Please note that, even if you unsubscribe from certain correspondence, we may still need to contact you with important transactional or administrative information, as permitted by law.  Additionally, if you withdraw your consent or object to processing, or if you choose not to provide certain Personal Information, we may be unable to provide some or all of our services to you.

8. International use of the Platforms

The Platforms are hosted in the United States and is intended to comply with the laws and regulations of the United States of America. If you are visiting the Platforms from outside of the United States, please note that by providing your Personal Information, it is being transferred to, stored, collected, or processed in the United States, where our data center and servers are located and operated, but does not have the same data protection laws as the European Union and other regions. We make no representations that our Platforms are appropriate or available for use in any location outside of the United States.

9. Children’s Privacy

No one under the age of 16 may provide any information to or on the Website.  We do not knowingly collect or solicit any Personal Information from children under the age of 16.  If you are under 16, do not use or provide any information on this Website. In the event that we learn that we have collected Personal Information from a child under 16, we will promptly delete that information. If you are a parent or legal guardian and think your child has given us their Personal Information, you can contact us using the information listed in Section 13.

10. Links to Third-Party Websites

For your convenience, the Site may contain links to other websites.  We are not responsible for the practices employed by any websites or services linked to or from the Platforms, including the information or content contained within them. We encourage you to investigate and ask questions before disclosing Personal Information to third parties, since any Personal Information disclosed will be subject to the applicable third party’s privacy policy.

11. Supplemental Policy for California Residents

This Section applies to our collection and use of “Personal Information” only if you are a resident of California. As a New Jersey entity, Access Bio does not offer the provisions of this section to any other consumer of the Platforms.

In compliance with the California Consumer Privacy Act of 2018 and its implementing regulations (the “CCPA”). This Section describes (1) the categories of Personal Information, collected and disclosed by us, subject to CCPA, (2) your privacy rights under CCPA, and (3) how to exercise your rights.  The CCPA provides consumers (California residents) with specific rights regarding their personal information and this section describes your CCPA rights and explains how to exercise those rights.

When we use the term “Personal Information” in the context of the CCPA, we mean information that identifies, relates to, describes, is capable of being associated with, or could reasonably be linked, directly or indirectly, with a particular California consumer or household.

Access

The right to request the categories of Personal Information that we collected in the previous twelve (12) months, the categories of sources from which the Personal Information was collected, the specific pieces of Personal Information we have collected about you, and the business purposes for which such Personal Information is collected and shared. You may also have the right to request the categories of Personal Information which were disclosed for business purposes, and the categories of third parties in the twelve (12) months preceding your request for your Personal Information.

Data Portability

The right to receive the Personal Information you have previously provided to us.

Erasure

The right to have your Personal Information deleted. However, please be aware that we may not fulfill your request for deletion if we (or our service provider(s)) are required or permitted to retain your Personal Information for one or more of the following categories of purposes: (1) to complete a transaction for which the Personal Information was collected, provide a good or service requested by you, or complete a contract between us and you; (2) to ensure our website integrity, security, and functionality; (3) to comply with applicable law or a legal obligation, or exercise rights (including free speech) under the law; or (4) to otherwise use your Personal Information internally, in a lawful manner that is compatible with the context in which you provided it.  We may also notify you that erasure is not possible if we cannot verify possessing your information.  We also may retain a confidential record of deletion for purposes of compliance with law.

To Opt Out

The right to opt out of the sale of your Personal Information.  Please email us at info@accessbio.net to opt out.

To Correct

The right to ask us to correct any personal information you believe is inaccurate considering the nature and purposes of the information.  We may deny a request if we determine that the information in question is more likely than not based on:  (1) the nature of the information; (2) how we obtained the information, and (3) documentation relating to the accuracy of the information.  Alternatively, we may delete information we refuse to change if deletion does not negatively impact you.

To Limit Use of Personal Information

You can request we limit use and disclosure of sensitive personal information to certain purposes related to the offering of goods or services as listed in the CPRA.  Please email us at info@accessbio.net to request such limitations.

Exercising Access, Data Portability and Deletion Rights.  If you would like to exercise your rights listed above, please send (or have your authorized agent send) an email to info@accessbio.net or call us at: 732-873-4040. Please note: you will not be discriminated against in any way by virtue of your exercise of the rights listed below, which means we will not deny goods or services to you, provide a different prices or rates for goods or services to you, or provide a different level or quality of goods or services to you.  However, we may offer you certain financial incentives permitted by the CCPA that can result in different prices, rates, or quality levels. Any CCPA-permitted financial incentive we offer will reasonably relate to your personal information’s value and contain written terms that describe the program’s material aspects. Participation in a financial incentive program requires your prior opt in consent, which you may revoke at any time.

We must verify your identity before fulfilling your requests.  If we cannot initially verify your identity, we may request additional information to complete the verification process. Any Personal Information you disclose to us for purposes of verifying your identity will solely be used for the purpose of verification.  If you are an authorized agent making a request on behalf of a California consumer, we will also need to verify your identity, which may require proof of your written authorization or evidence of a power of attorney.   

You may only make a verifiable consumer request for access or data portability twice within a 12-month period. The verifiable consumer request must: (a) Provide sufficient information that allows us to reasonably verify you are the person about whom we collected personal information or an authorized representative; and (b) describe your request with sufficient detail that allows us to properly understand, evaluate, and respond to it.

Response Timing and Format. We endeavor to respond to a verifiable consumer request within forty-five (45) days of its receipt. If we require more time (up to 90 days), we will inform you of the reason and extension period in writing.  If you have an account with us, we will deliver our written response to that account. If you do not have an account with us, we will deliver our written response by mail or electronically, at your option.  Any disclosures we provide will only cover the 12-month period preceding the verifiable consumer request’s receipt. The response we provide will also explain the reasons we cannot comply with a request, if applicable. For data portability requests, we will select a format to provide your personal information that is readily useable and should allow you to transmit the information from one entity to another entity without hindrance.  We do not charge a fee to process or respond to your verifiable consumer request unless it is excessive, repetitive, or manifestly unfounded. If we determine that the request warrants a fee, we will tell you why we made that decision and provide you with a cost estimate before completing your request.

We may deny certain requests, or only fulfill some in part, as permitted or required by law.  For example, if you request to delete Personal Information, we may retain Personal Information that we need to retain for legal purposes (e.g., tax accounting).  You have a right not to receive discriminatory treatment by any business when you exercise your California privacy rights.

The CCPA gives California Consumers the right to lodge a complaint with the California Attorney General’s office. The Attorney General’s office may be contacted at https://oag.ca.gov/contact/consumer-complaint-against-business-or-company or by telephone at: (916) 210-6276.

Other California Privacy Rights

California’s “Shine the Light” law (Civil Code § 1798.83) permits users of our Platforms that are California residents to request certain information regarding our disclosure of personal information to third parties for their direct marketing purposes. To make such a request, please send an email to the address identified below.

12. Changes to this Privacy Policy 

Please note that we may modify or update this Privacy Policy from time to time, so please review it periodically. The date the privacy policy was last revised is identified at the bottom of the page.  You are responsible for reviewing this Policy for changes, as your use of the Platforms means that you accept the revised Privacy Policy.  We may provide you with an updated Privacy Policy if material changes are made. Unless otherwise indicated, any changes to this Privacy Policy will apply immediately upon posting to the Platforms.
